Contract Claims
The commercial interests of those involved in the construction process are often competitive. When the inherent risks of construction eventuate, these competing interests can lead to claims and possibly even disputes. As disputes can destroy an otherwise successful project it is important that claims get resolved efficiently and fairly.
In the construction industry a claim generally refers to either a claim for payment by a contractor or a complaint about performance by the owner. In these types of claims, there is often no obvious, acceptable answer. Common claims bases may include:
* defective work,
* variations,
* delay and extension of time, and,
* latent conditions.
